Welcome to FIND AND FIX (“the Platform”, “we”, “us”, or “our”). These Terms and Conditions govern your access to and use of the FIND AND FIX website, web app, and related services.

By accessing or using the Platform, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the Platform.

• Use of the platform

FIND AND FIX is a directory platform that connects homeowners, tenants, estate agents, and independent local service providers.

Users may browse listings, search for service providers, and contact listed businesses directly. Service providers and estate agents may create listings and promote their services through the Platform.

We may update, change, suspend, remove, or restrict any part of the Platform at any time without prior notice.

• Accuracy of information

We aim to keep listings current and useful. However, we do not guarantee that any listing, profile, review, contact detail, service description, rating, image, video, reference, or other content on the Platform is accurate, complete, reliable, or up to date.

Listing information is supplied by third parties, including service providers and estate agents. FIND AND FIX is not responsible for verifying every listing, statement, qualification, reference, review, or claim published on the Platform.

Any reliance you place on information found on the Platform is entirely at your own risk.

• Advertiser and listing responsibilities

Any business, service provider, or estate agent submitting information to FIND AND FIX confirms that the information provided is accurate, truthful, lawful, current, and does not infringe the rights of any third party.

By submitting personal or business information for a listing, you consent to that information being published on the Platform and made available to users.

Advertisers and listed businesses remain solely responsible for their own content, representations, pricing, services, qualifications, conduct, and compliance with all applicable laws, regulations, licensing requirements, industry rules, and professional obligations.

• Independent service providers

FIND AND FIX is an information and referral platform only. We provide a directory that allows users to identify and contact independent service providers and estate agents operating in their area.

FIND AND FIX does not employ, appoint, supervise, manage, control, endorse, warrant, or guarantee any service provider, estate agent, contractor, subcontractor, artisan, technician, or other listed business.

Any quotation, inspection, call-out, repair, installation, maintenance work, advice, timeline, payment arrangement, warranty, guarantee, or other agreement relating to services listed on the Platform is concluded directly between the user and the relevant service provider or estate agent. FIND AND FIX is not a party to that agreement and accepts no responsibility for its performance, non-performance, or enforcement.

Users remain responsible for satisfying themselves that a service provider is suitable for their needs, properly qualified where required, appropriately insured where relevant, available to perform the work, and compliant with any applicable legal, regulatory, municipal, safety, or industry requirements.

• No warranty

The Platform and all listings, content, features, and information made available through it are provided on an “as is” and “as available” basis.

To the fullest extent permitted by applicable law, FIND AND FIX gives no representation or warranty, whether express, implied, or statutory, regarding:

• the accuracy, completeness, reliability, legality, quality, safety, availability, or suitability of any listing or service provider;
• the qualifications, licences, registrations, certifications, insurance, experience, conduct, creditworthiness, or workmanship of any listed business;
• the outcome, quality, timing, price, safety, or legality of any services provided by third parties;
• the uninterrupted, secure, error-free, or virus-free operation of the Platform; or
• the availability of any listed provider in any specific area or at any specific time.

Any reliance on the Platform, its listings, reviews, references, ratings, or other content is entirely at your own risk.

• Protection of Personal Information (POPIA)

We are committed to handling personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA).

By using the Platform, you consent to the collection, processing, storage, and display of personal information where necessary for the operation of the Platform and its listings.

We take reasonable technical and organisational measures to protect personal information against loss, misuse, unauthorised access, disclosure, or destruction.

You may request access to, correction of, or deletion of your personal information by contacting us at support@findandfix.co.za.

• Limitation of liability

To the fullest extent permitted by South African law, FIND AND FIX, its owners, directors, members, employees, agents, affiliates, licensors, contractors, and representatives will not be liable for any direct, indirect, incidental, special, consequential, or punitive loss, damage, cost, claim, or expense of any kind arising from or relating to:

• the use of, or inability to use, the Platform;
• any listing, profile, review, rating, reference, advertisement, video, image, or other content published on the Platform;
• any inaccuracy, omission, misrepresentation, outdated information, or unlawful content submitted by a third party;
• any act, omission, negligence, misconduct, delay, abandonment, poor workmanship, defective work, overcharging, non-delivery, property damage, theft, injury, death, or other harm caused by a service provider or any other third party;
• any dispute, complaint, claim, refund issue, payment dispute, or contractual disagreement between a user and a listed business or estate agent;
• any temporary outage, interruption, technical failure, data loss, cyber incident, unauthorised access, or other event beyond our reasonable control; or
• any decision made or action taken by a user based on information obtained through the Platform.

Without limiting the above, FIND AND FIX will not be liable for any loss of profit, loss of income, loss of opportunity, loss of business, loss of data, reputational harm, or any indirect or consequential damages, even if we were advised of the possibility of such loss.

• Electronic communications

By using the Platform, you agree to receive electronic communications from us, including service-related messages, notices, updates, and marketing communications, subject to your communication preferences and any opt-out rights available under applicable law.

Any notices, disclosures, agreements, or communications sent electronically satisfy any legal requirement that they be in writing.

• Intellectual property

Unless otherwise stated, all content on the Platform, excluding user-submitted listings and third-party materials, including text, branding, graphics, logos, layout, and software, belongs to FIND AND FIX or its licensors and is protected under South African law.

You may not reproduce, copy, distribute, modify, publish, display, license, sell, or exploit any part of the Platform without our prior written consent.

• Third-party links

The Platform may include links to third-party websites, social media pages, booking tools, videos, or other external platforms for convenience.

We do not control those third-party platforms and are not responsible for their content, security, privacy practices, terms, or availability.

• Amendments to these terms

We may update these Terms and Conditions from time to time. Any changes will be posted on this page with the updated version date.

Your continued use of the Platform after changes are published means you accept the revised Terms and Conditions.

• Governing law and jurisdiction

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute arising from or relating to these Terms and Conditions or the use of the Platform will be subject to the jurisdiction of the South African courts.

• Legal review disclaimer

These Terms and Conditions are intended to set out the general legal and operational framework of the FIND AND FIX platform.

They do not constitute legal advice. Although care has been taken in drafting this document with reference to relevant South African legislation, including POPIA, the Electronic Communications and Transactions Act, the Consumer Protection Act, and applicable common law principles, FIND AND FIX recommends that these Terms and Conditions be reviewed by a qualified South African legal practitioner before publication or implementation.

Bycontinuing to use the Platform, users, advertisers, and listed businesses confirm that they have read, understood, and agreed to these Terms and Conditions.

• User assumption of risk

By using FIND AND FIX, you acknowledge that engaging a third-party service provider carries inherent risks, including risks relating to pricing, quality of workmanship, delays, safety, access to property, damage to property, and disputes about the scope of work.

You agree that you appoint and engage any service provider entirely at your own discretion and risk.

• Indemnity

You agree to indemnify, defend, and hold harmless FIND AND FIX, its owners, directors, members, employees, agents, affiliates, and representatives from and against any loss, liability, damage, cost, or expense, including reasonable legal costs, arising out of or relating to:

• your use of the Platform;
• your breach of these Terms and Conditions;
• your reliance on any listing or third-party content;
• any dispute between you and a service provider, estate agent, advertiser, or other user; or
• any claim brought by a third party arising from your conduct, instructions, property access arrangements, or dealings with a listed business.

• No endorsement

The inclusion of a business, service provider, estate agent, review, reference, rating, badge, or category listing on FIND AND FIX does not amount to an endorsement, vetting guarantee, accreditation, partnership, or certification by FIND AND FIX, unless expressly stated otherwise in writing.

Any references, recommendations, ratings, or reviews displayed on the Platform are informational only and should not be treated as a guarantee of future performance.

• General disclaimer

FIND AND FIX is a directory and referral platform only. All service providers and estate agents listed on the Platform operate independently. FIND AND FIX does not perform the services advertised and is not responsible for any quotations, workmanship, delays, damage, losses, disputes, or other issues arising from services provided by third parties. Any agreement for services is concluded directly between the user and the relevant provider.

Privacy Policy

FIND AND FIX (“the Platform”, “we”, “us”, or “our”) respects your privacy and is committed to handling personal information responsibly and in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA). POPIA sets minimum requirements for lawful processing of personal information, and the Information Regulator oversees compliance in South Africa.  

This Privacy Policy explains what personal information we collect, how we use it, and when we may share it.

• Information we collect

We may collect and process:

• your name, surname, phone number, email address, and other contact details;
• business information submitted for listings, including company name, services, location, social media links, certifications, images, videos, references, and reviews;
• information you submit through contact forms, listing applications, or support requests;
• location-related information where needed to show relevant service providers in your area; and
• technical information such as browser type, device information, IP address, and usage data collected through the website or web app.
• How we use your information

We use personal information to:

• operate and improve the FIND AND FIX platform;
• create, manage, and display listings;
• connect users with relevant local service providers and estate agents;
• communicate with you about enquiries, support, updates, or account-related matters;
• send marketing communications where permitted by law;
• maintain the security and functionality of the Platform; and
• comply with legal and regulatory obligations.

• Sharing of information

We may share personal information:

• where it is included in a public business or estate agent listing;
• with service providers or contractors who help us operate the Platform;
• where disclosure is required by law, regulation, court order, or lawful request; or
• where necessary to protect our rights, users, or the integrity of the Platform.

We do not sell personal information to third parties.

• Storage and security

We take reasonable technical and organisational measures to protect personal information against loss, misuse, unauthorised access, disclosure, or destruction, as required by POPIA. POPIA also requires responsible parties to notify the Information Regulator and affected data subjects when a security compromise occurs.  

We keep personal information only for as long as reasonably necessary for operational, legal, or record-keeping purposes.

• Your rights

Subject to applicable law, you may request:

• access to the personal information we hold about you;
• correction of inaccurate or incomplete information; or
• deletion of personal information where retention is no longer necessary or lawful.
